Background of the Study:
Nigeria is a signatory to numerous international human rights treaties, including the International Covenant on Civil and Political Rights (ICCPR) and the African Charter on Human and Peoples' Rights. These treaties are meant to guarantee fundamental human rights, such as the right to life, freedom from torture, and access to justice. However, the implementation of these treaties has often been inconsistent in Nigeria, with many human rights violations still occurring on a large scale (Bako & Aliyu, 2023). In regions like Maiduguri, Borno State, the impact of insurgencies and internal displacement has further complicated the enforcement of these rights.
The insurgency by Boko Haram has placed enormous pressure on the state's ability to protect human rights. While international treaties require governments to take necessary measures to prevent human rights abuses, Nigeria’s capacity to fully implement such obligations remains under scrutiny. This study seeks to assess the extent to which Nigeria has implemented international human rights treaties in Maiduguri, focusing on the challenges and successes experienced in the region. It will explore the role of governmental institutions, civil society organizations, and the international community in the protection and enforcement of human rights under international law.
Statement of the Problem:
Despite Nigeria’s commitment to international human rights treaties, the country continues to experience widespread human rights violations, particularly in conflict zones like Maiduguri, Borno State. The Boko Haram insurgency has exacerbated the human rights situation, with numerous reports of arbitrary arrests, displacement, and violations of the right to life. This study seeks to explore the effectiveness of implementing international human rights treaties in Maiduguri and the challenges faced in ensuring that Nigeria meets its obligations under international law.
Objectives of the Study:
To evaluate the extent to which international human rights treaties have been implemented in Maiduguri, Borno State.
To identify the challenges hindering the full implementation of international human rights treaties in Maiduguri.
To suggest recommendations for improving the implementation of international human rights treaties in Maiduguri.
Research Questions:
To what extent have international human rights treaties been effectively implemented in Maiduguri, Borno State?
What are the major challenges faced in the implementation of these treaties in Maiduguri?
What steps can be taken to improve the enforcement of international human rights treaties in Maiduguri?
Research Hypotheses:
International human rights treaties have not been fully implemented in Maiduguri, Borno State, due to conflict-related challenges and systemic barriers.
Political instability and lack of capacity in local institutions significantly hinder the implementation of international human rights treaties in Maiduguri.
Strengthening the role of civil society organizations and international actors can enhance the enforcement of international human rights treaties in Maiduguri.
Scope and Limitations of the Study:
The study will focus on the implementation of international human rights treaties in Maiduguri, particularly in the context of the Boko Haram insurgency. It will assess both governmental and non-governmental efforts to enforce human rights. Limitations may include access restrictions due to security concerns in conflict zones and challenges in obtaining reliable data.
